Do you need a licensed drone pilot for real estate photos?
Yes. In the US, any drone flight for a real estate listing counts as commercial, so the pilot must hold an FAA Part 107 Remote Pilot Certificate. Flying without one for marketing photos is illegal, and many MLSs and brokerages now ask for proof. In controlled airspace, which covers most of NYC, the pilot also needs FAA authorization for that specific location.
The rule
Flying a drone to photograph a home that is for sale is a commercial operation. The FAA requires the operator to hold a Part 107 Remote Pilot Certificate. This is not the same as registering a drone or holding a recreational flyer certificate.
A Part 107 pilot has been tested on:
- Airspace classes and how to read a sectional chart
- Weather and how it affects flight
- Altitude limits, the 400-foot ceiling, and visibility minimums
- Rules on flying over people and moving vehicles
- Aircraft registration and pre-flight checks
Why NYC is stricter
- Controlled airspace. Most of Brooklyn, Queens, and Manhattan is near a major airport. Flights there need FAA authorization for the exact location, usually through LAANC, sometimes a manual request that takes longer.
- Launch points. Taking off and landing from NYC public property is restricted. A licensed operator plans a legal launch spot before the shoot.
- Buildings and people. Dense blocks mean more planning around people, traffic, and line of sight.

Hire a provider who:
- Holds a current Part 107 certificate
- Carries drone liability insurance
- Handles airspace authorization for your address, not just “we’ll figure it out on the day”
